1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of PromptCanvas, an independently operated service by an individual developer ("PromptCanvas," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older and legally able to enter into these Terms.

3. The Service

PromptCanvas provides tools related to structured prompt writing, AI-assisted image generation, image history management, and related account features.

We may modify, suspend, or discontinue all or part of the Service at any time.

4. Accounts

You may need an account to use some or all features of the Service. You are responsible for:

• Providing accurate account information
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

You must notify us promptly if you believe your account has been compromised.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, abusive, or harmful purposes
• Use the Service to generate pornographic, sexually explicit, or NSFW content
• Use the Service to generate sexualized content involving minors, or any exploitative depiction of minors
• Use the Service to create deepfakes, face swaps, impersonation media, or other misleading synthetic identity content
• Use the Service to generate hateful, harassing, violent, or seriously graphic content where doing so creates safety or compliance risk
• Interfere with the operation or security of the Service
• Attempt to gain unauthorized access to systems, accounts, or data
• Circumvent rate limits, credit limits, or security controls
• Upload, submit, or request content that infringes intellectual property or other rights
• Use the Service to create content that violates applicable law or the rights of others

We may suspend or terminate access if we reasonably believe you violated these Terms.

6. Your Content

You retain whatever rights you may have in the content you submit to the Service, subject to applicable law and third-party rights.

You grant us a limited, non-exclusive right to host, process, store, reproduce, and transmit your submitted content only as necessary to operate, secure, maintain, and improve the Service for you.

You represent that you have the necessary rights to submit your content and request its processing.

7. Generated Output

AI-generated output may be imperfect, unavailable, or similar to content generated for other users. You are responsible for reviewing and determining whether generated output is appropriate for your intended use.

We do not guarantee that generated output will be accurate, unique, non-infringing, merchantable, or fit for any particular purpose.

8. Intellectual Property

The Service, including its software, design, branding, and non-user content, is protected by applicable intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service.

9. Credits, Plans, and Future Paid Features

PromptCanvas may use credits, usage records, plan limits, or feature gating.

If you purchase a paid plan, subscription, or other paid feature:

• Subscriptions renew automatically at the billing interval shown at checkout unless you cancel before renewal.
• You can cancel from the billing area inside PromptCanvas or through the Creem Customer Portal. Unless checkout terms or applicable law require otherwise, cancellation stops future renewals and your current paid access remains available until the end of the active billing period.
• Refund requests are reviewed under the refund terms presented at checkout and our then-current refund policy. If a refund is approved, it is returned to the original payment method and related paid access may end when the refund is processed.

We may change feature limits, pricing structures, credit rules, or plan availability at any time to the extent permitted by law.

10. Third-Party Services

The Service may rely on third-party providers, including providers for authentication, hosting, storage, security verification, and AI model processing. We are not responsible for third-party services except as required by applicable law.

11. Privacy

Your use of the Service is also governed by our Privacy Policy and Cookie Policy.

12. Service Availability

We try to keep the Service available and secure, but we do not guarantee uninterrupted availability, error-free operation, or that the Service will always meet your expectations.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied.

14. Limitation of Liability

To the maximum extent permitted by law, PromptCanvas and its operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising from or related to your use of the Service.

If applicable law does not allow certain limitations, those limitations apply only to the maximum extent permitted by law.

15. Indemnity

You agree to indemnify and hold harmless PromptCanvas and its operator from claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your violation of applicable law or third-party rights

16. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe it is necessary for security, legal compliance, operational reasons, or violation of these Terms.

You may stop using the Service at any time.

17. Governing Law

These Terms will be governed by applicable law in the jurisdiction determined by the operator, unless otherwise required by mandatory law. If a specific governing law or dispute forum later becomes necessary, we may update these Terms accordingly.

18. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted with a revised effective date. Your continued use of the Service after the update means you accept the revised Terms.

• 使用本服务创建 deepfake、换脸、冒充他人身份或其他具有误导性的合成身份内容
• 使用本服务生成仇恨、骚扰、严重暴力、血腥冲击等会带来安全或合规风险的内容
• 干扰服务运行或破坏服务安全
• 试图未经授权访问系统、账户或数据
• 规避速率限制、积分限制或安全控制
• 上传、提交或请求处理侵犯知识产权或其他权利的内容
• 使用本服务生成违反适用法律或侵犯他人权利的内容

如果我们有合理理由认为您违反了本条款，我们可以暂停或终止您的访问权限。

6. 您的内容

在适用法律和第三方权利约束下，您对您提交到服务中的内容保留其原有权利。

您授予我们一项有限的、非独占的权利，以便在为您运营、保护、维护和改进服务所必需的范围内，对您提交的内容进行托管、处理、存储、复制和传输。

您声明您有权提交相关内容并请求我们处理该内容。

7. 生成结果

AI 生成内容可能并不完美、可能不可用，也可能与其他用户获得的内容相似。您有责任自行审查生成结果，并判断其是否适合您的使用目的。

我们不保证生成结果一定准确、唯一、不侵权、具有适销性或适用于任何特定目的。

8. 知识产权

本服务及其软件、设计、品牌和非用户内容受适用知识产权法律保护。除非本条款明确允许，否则您不得复制、修改、分发、出售、出租、反向工程或基于本服务创建衍生作品。

9. 积分、套餐与未来付费功能

PromptCanvas 可能使用积分、使用记录、套餐限制或功能分层机制。

如果您购买付费套餐、订阅或其他付费功能：

• 除非您在续费前取消，否则订阅会按照结账页展示的计费周期自动续费。
• 您可以在 PromptCanvas 产品内的账单管理区域取消订阅，也可以通过 Creem Customer Portal 取消。除非结账页条款或适用法律另有要求，取消后只会停止后续自动续费，当前已支付周期内的权益会保留至本期结束。
• 退款申请会根据结账页展示的退款条款以及我们当时有效的退款政策进行审核。若退款获批，款项将原路退回，相关付费权限可能会在退款处理完成时终止。

在法律允许范围内，我们可以随时调整功能限制、价格结构、积分规则或套餐可用性。

10. 第三方服务

本服务可能依赖第三方提供商，包括身份验证、托管、存储、安全验证和 AI 模型处理服务商。除非适用法律另有要求，我们不对第三方服务本身负责。

11. 隐私

您对本服务的使用同时受我们的《隐私政策》和《Cookie 政策》约束。

12. 服务可用性

我们会尽力保持服务可用与安全，但不保证服务持续不中断、绝对无错误，或始终满足您的预期。

13. 免责声明
